This photograph was taken in 1912 for postcards of faculty members at the University of Göttingen which were sold to students at the time (see "Hilbert", Constance Reid, Springer 1970). It was therefore published before 1923. Since it is not written in a foreign language, it is public domain in the US.

It is likely that the original copyright holder was the photographer, and it is reasonable to assume that someone of professional age in 1912 died before 1957. This does not affect the copyright status in the US, but may mean that the image is also in the public domain in countries where the copyright term is life of author plus 50 years.
